Shipfreak Terms of Service
These Terms govern your use of the Shopify apps Shipfreak — AI bundle checkout and Shipfreak — Upload POD ("the Apps") and the related services at shipfreak.com ("the Service"). By installing or using the Apps, you ("Merchant") agree to these Terms.
1. Who we are
The Apps and Service are operated by Legacy Bridge / KiddieSketch LLC (New Jersey, USA) — collectively "Shipfreak", "we", or "us". Contact: supportteam@shipfreak.com.
2. Eligibility & account
- You must have an active Shopify store and the authority to install apps on it.
- You are responsible for all activity in your Shopify store related to the Apps, including charges incurred via third-party providers.
- You must comply with Shopify's Acceptable Use Policy and Partner Program Agreement while using the Apps.
3. License grant
Subject to these Terms, Shipfreak grants you a non-exclusive, non-transferable, revocable license to install and use the Apps in your Shopify store for the purpose of operating that store. You may not:
- Resell, sublicense, or distribute the Apps to third parties.
- Reverse engineer, decompile, or attempt to extract source from the Apps beyond what Shopify or applicable law permits.
- Use the Apps to violate any law, third-party right, or Shopify's policies.
- Use the Apps to generate, fulfill, or sell content that depicts minors in sexual contexts, real violence against identifiable persons, or other content prohibited under U.S. federal law.
4. Bundle and offer logic — owner control
The AI bundle checkout App suggests bundles, quantity breaks, free gifts, BOGO, and bulk discounts. You acknowledge:
- You control the publishing settings (suggest-only, approval-required, auto-publish) for each offer type.
- You are responsible for reviewing AI-suggested offers before they go live, including for margin impact, inventory availability, and legal compliance.
- Pricing sync settings (when enabled) modify your Shopify product prices automatically. You are responsible for verifying the resulting prices match your intent.
- Shipfreak provides AOV measurement as a guidance tool. Reported figures are derived from Shopify analytics and Shipfreak's own logs and may differ from your accounting records.
5. Customer-facing AI content (Upload POD)
The Upload POD App generates images using AI models. You acknowledge:
- Generated images may not be unique or original. We do not warrant that AI-generated outputs are free of similarity to other generated works.
- You are responsible for reviewing AI-generated outputs before using them in shipped products, marketing, or merchandise.
- Prompts submitted to the App are appended with safety language ("child-friendly, safe for all ages") and may be filtered or refused by the underlying model.
- Shipfreak is not the rights-holder of AI outputs. Rights to outputs follow the terms of the underlying AI provider (e.g., Cloudflare Workers AI, Pollinations.ai). You are responsible for complying with those terms.
6. Third-party services
The Apps integrate with third-party services to function. Use of those services is subject to their own terms:

7. Fees and billing
If an App is offered with a paid plan or usage-based pricing, charges are billed through Shopify's standard billing API and appear on your Shopify invoice. You authorize Shopify to charge your store's payment method on Shipfreak's behalf. Refunds are handled at our discretion and per Shopify's app refund guidelines.
Free plans (where offered) may include reasonable usage limits. We may apply rate limits, queues, or temporary cutoffs to prevent abuse without prior notice.
8. Service availability
We aim for high availability but do not commit to a specific SLA at the free tier. The Apps may experience downtime due to Shopify outages, third-party AI provider outages, scheduled maintenance, or other factors. We are not liable for losses caused by service downtime unless explicitly committed in a written agreement.
9. Termination
- You may uninstall the Apps at any time from your Shopify admin. Uninstalling stops all data flow and triggers our GDPR redact webhook (see Privacy Policy).
- We may suspend or terminate your access if you violate these Terms, abuse the service, or use the Apps for illegal activity, with or without notice.
- Upon termination, sections 5, 10, 11, 12, and 13 survive.
10. Intellectual property
The Apps, including source code, UI, branding, and documentation, are owned by Shipfreak. You retain ownership of your store data, customer data, and the original input files (sketches, photos) you or your customers upload to the Apps.
11. Disclaimer of warranties
THE APPS AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SHIPFREAK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA, AI OUTPUTS, OR REVENUE FIGURES.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SHIPFREAK'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APPS IS LIMITED TO THE GREATER OF (A) $50 USD OR (B) THE AMOUNT YOU PAID SHIPFREAK FOR THE APPS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
IN NO EVENT WILL SHIPFREAK BE LIABLE FOR INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Indemnification
You agree to indemnify and hold Shipfreak harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from: (a) your use of the Apps in violation of these Terms; (b) content you submit to the Apps; or (c) your sale of merchandise using AI-generated outputs or Shipfreak-suggested bundle prices.
14. Governing law & disputes
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in New Jersey, and you consent to personal jurisdiction there.
15. Changes
We may update these Terms from time to time. Material changes will be announced via the App admin or via email to the Shopify-listed contact for your store. Continued use of the Apps after a change constitutes acceptance.
